
PSYCHOSOCIAL SUPPORT AGREEMENT
This Individual Psychosocial Support (PSS) Agreement is made between Kate Roberts Consulting (herein referred to as“The Company”) and yourself (herein referred to as “The Client”), whereby the Company will provide PSS Services, identified as business-to-consumer e-commerce. Upon submitting payment, you (“The Client”) agree to be provided with products, programs and services by Kate Roberts (“The Counselor”), acting on behalf of Kate Roberts Consulting (“TheCompany”), and you are entering in to a binding agreement with the Company. Both the Company and the Client hereby agree to abide by all policies and procedures as outlined in this agreement, including the following terms and conditions:
CONTEXT AND ROLES
Psychosocial Support (PSS) is a process in which the Counselor serves as a strategic partner of the Client to explore goals, barriers, action steps and accountability plans for moving forward. PSS is client-focused and client-driven with theClient choosing their priorities and action steps. The Counselor serves to provide perspective, create focus, clarify intention, motivate and build accountability through empowering the Client. The Counselor and the Client recognize the purpose of the PSS relationship and that the process is for the Client to explore their goals and create change based on the Client’s choice. The Counselor and the Client agree to focus on what the Client wants, exploring options and challenges, developing strategies, defining action steps, and for accountability. The Counselor does not provide advice of any kind. The Counselor may brainstorm with the Client or share examples for perspective, and the Client makes all choices and decisions for themself. The Counselor and the Client are both expected to enter into the Individual PSSAgreement with integrity and intention of completion of agreed-upon sessions.
PSS PROCEDURE AND EXPECTATIONS
1. The Client’s information and communications shall be confidential. The Counselor must disclose information brought to their attention that is an unreported crime or a threat of harm.
2. The Individual PSS sessions are scheduled via online calendar links. Rescheduling of an Individual PSS session can be initiated by either the Counselor or the Client and should be done with a minimum of 24-hour notice. If theClient does not reschedule, the appointment is considered complete as scheduled. Frequent rescheduling may lead to requiring a 72-hour notice.
3. All PSS sessions will be conducted via Zoom, unless otherwise arranged together between Counselor and Client.It is the Client’s responsibility to ensure they have access to appropriate technology to facilitate the link.
4. The Counselor and the Client must start and finish each session promptly on time. Subject to the following: that if either individual is more than 10 minutes late for a PSS session, the other individual may assume the session is cancelled and the session fee will be forfeited or refunded as the case may be.
5. The Counselor will maintain brief session notes. When the PSS relationship is complete, the Counselor will only keep the notes for six months after which the only file retained is a general abstract and this agreement.
6. The Counselor will provide the Client with a post-session email, which may include supplemental links, resources and recommendations in addition to a link to the session recording if the Client has indicated approval. The Client is invited to email the Counselor up to three times in-between sessions, and for 6-, 9-, and 12-session packages is invited to one support call (of up to 15 minutes) in-between sessions. Support calls are based on availability, and conducted via Skype, WhatsApp or other agreed-upon platform.
7. If there is something that could be perceived as a conflict of interest, the Counselor will identify this to the Client and explore interest in continuing the PSS sessions and/or discuss appropriate alternatives.
CONFIDENTIALITY
The PSS relationship is built on trust. The Company agrees that the Counselor will keep all conversations and information provided by the Client private and confidential. No personal ideas, information or thoughts expressed by the Client will be shared with anyone except with the written permission of the Client. The Counselor is not protected by doctor-client confidentiality.
CLIENT RESPONSIBILITY
The Client accepts and agrees that the Client is 100% responsible for their progress and results from the Counselor program. The Company makes no representations, warranties or guarantees verbally or in writing. The Client understands that because of the nature of the program and extent, the results experienced by each client may significantly vary. While the Client’s participation is voluntary, the Client understands that their participation level will have significant impact on how they experience the PSS program as well as their results and level of satisfaction. It is the Client’s responsibility to ensure. that all sessions are scheduled prior to the expiration date of the PSS package. If the package expires before the Client schedules all sessions, a $50 Re-activation Fee will be applied. It is the Client's responsibility to retain, save, or bookmark the scheduling links of the PSS Package. If lost or misplaced and replacement links are required, a $50 Administration Fee will be applied.
DISCLAIMER
The Counselor is not an attorney, doctor, manager, dietician, financial analyst or accountant and does not give advice. The Client understands that a relationship does not exist between the parties after the conclusion of the PSS program. If the Client and the Counselor continue their PSS relationship, a separate agreement will be entered into. If the Client chooses to upgrade their Package, prior to their initial package expiring and after the halfway point within the initial Coaching Agreement, a $50 Administration Fee will be applied.
INTELLECTUAL PROPERTY RIGHTS
In respect of the documents specifically created for the PSS program, the Company maintains all of the copyright, including other intellectual property rights and any other data or material used or subsisting in the Material whether finished or unfinished. Nothing in this Agreement shall transfer ownership of or rights to any intellectual property of the Company to the Client, nor grant any right or license other than those stated in this Agreement.
LIMITATION OF LIABILITY
The Client agrees that they enter into the agreement at will and shall use the Company’s services at their own risk. TheClient releases the Company, from any and all damages that may result from any claims arising from any agreements, actions, causes of action, costs, demands and damages of any nature or kind in law or in equity arising from participation in the PSS program. The Counselor and the Client mutually agree to indemnify and hold each other harmless from any and all claims arising out of the PSS relationship except those willfully, intentionally, and knowingly intended to cause harm to another.
PAYMENT
Upon execution of this Agreement, the Client agrees to pay to the Company the full purchase amount. The Company does not offer refunds, with the intention of ensuring the Client is fully committed to the entirety of the PSS program. If an unforeseen circumstance occurs that causes the Client to quit the program, the Counselor may decide to partially refund at her discretion and is described below under ‘Termination.’
TERMINATION
The Company is committed to providing the Client with a positive Counselor experience. By purchasing this service, the Client agrees that the Company may, at its sole discretion, terminate this Agreement, and limit, suspend, or terminate the Client’s participation without refund if the Client fails to follow the discussed guidelines, is difficult to work with, or upon violation of the above terms as determined by the Company. In the event that the PSS program is terminated by the Company, for any reason (emergency, conflict of interest), the Client is entitled to a prorated refund of the unused portion of the paid fee. In the event that the Client has extenuating circumstances that impede their capacity to complete the PSS program, the Client may discuss options with the Company to either defer or transfer unused sessions.
ETHICAL CONSIDERATION
The Counselor is a member of the International Coach Federation (ICF) and is accountable to the ICF Code of Ethics, which can be accessed at: https://coachfederation.org/code-of-ethics. The Counselor may pursue additional credentialing with the ICF, which calls for submitting a log of coaching hours. The Client hereby gives permission for the Counselor to include their name, email, telephone, and the coaching hours for this purpose only.
